Operator: Avi Malhotra, an individual developer (GitHub: avimal5000).

This is a plain-language draft, not legal advice. It should be reviewed by a lawyer before commercial use.

By downloading, installing, or using Gander, you agree to these terms. If you do not agree, do not use Gander. See also the Privacy Policy.

What Gander is

Gander is a free desktop utility. It uses your webcam to estimate which way your head is turned and moves keyboard focus to the last window you used on the monitor you are looking at.

License

  • Gander is free to use for your own personal use.
  • The source code in the GitHub repositories is public so that you can read it, but it is not open source. All rights are reserved by the operator. This means you may not copy, redistribute, sell, sublicense, modify, or reverse engineer Gander, or build products from its source code, without written permission, except where the law allows it regardless of this term.
  • Gander includes third-party components with their own licenses (on Windows: ONNX Runtime and a face-landmark model; see THIRD-PARTY-NOTICES.md in the download). Those licenses apply to those components.

As is, with no warranty

Gander is provided "as is" and "as available", with no warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, reliability, and non-infringement. Gander may not work on your hardware, may misread where you are looking, and may have bugs.

Do not rely on it where a mistake is dangerous

Gander guesses from a camera image. It can be wrong. It may focus the wrong window or fail to switch.

  • Do not use Gander as a safety-critical control or as a medical, assistive, or accessibility-critical tool.
  • Do not use it where a keystroke going to the wrong window could cause harm or loss, for example when controlling equipment, trading, handling payments, administering systems, or entering credentials or private messages.
  • You can pause Tracking or use Focus Lock at any time. Check which window is active before you type something important.

Limitation of liability

To the fullest extent the law allows, the operator is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or lost time, arising from your use of Gander, even if told of the possibility. Total liability for any claim is limited to the amount you paid for Gander, which is zero. Some places do not allow these limits, so they may not apply to you in full. Nothing here limits liability that cannot be limited by law.

Acceptable use

You agree not to:

  • use Gander to watch, record, or identify other people without their knowledge or where the law forbids it;
  • use Gander in a way that breaks the law or someone's rights;
  • remove or hide notices, or pass Gander off as your own work;
  • distribute altered copies of Gander as though they came from the operator.

Camera and other people

You are responsible for who and what is in view of your camera while Gander runs, and for following the laws where you are, including rules about cameras in workplaces, shared spaces, and other people's homes. Gander processes images on your device and does not save or send them, but a camera still sees whatever is in front of it. Tell people nearby when it matters. Use Gander only on computers and cameras you are allowed to use.

If more than one face is in view, Gander may track the wrong person.

Permissions and your system

Gander needs Camera permission (and on macOS, Accessibility permission). You grant and revoke these in your system settings. You are responsible for your own computer, its security, and your backups. Gander may be distributed without a code-signing certificate or Apple notarization, which makes your system show a warning. Only run builds you downloaded from the official GitHub Releases pages, and check the .sha256 file.

No support obligation

Gander is free and maintained on a best-effort basis. The operator has no duty to provide support, fixes, updates, or new features, or to keep any version available. Gander does not update itself. To update, download the new version.

Termination

You can stop at any time by quitting and deleting Gander (see "Delete your data" in the Privacy Policy). The operator can end your permission to use Gander at any time, for example if you break these terms, and can stop distributing it. Sections that by their nature should survive (warranty disclaimer, limitation of liability, governing law) survive termination.

Governing law

These terms are governed by the laws of Ontario, Canada, and the federal laws of Canada that apply there. Disputes go to the courts of Toronto, Ontario, unless the law of your home country gives you a right to a different venue.

Changes

I may change these terms. When I do, I will change the effective date above and publish the new text in the repository. Using Gander after a change means you accept it. Earlier versions stay in the repository history.
